US District Judge Sam Cummings with the Northern District of Texas has dismissed a lawsuit filed against the City of Levelland in after an officer involved shooting in January 2015.
Judge Sam Cummings issued his decision late last week, in his decision the judge granted summary judgement in the case and denied a request for cross summary judgement filed by the plantiff. The judge also said in his ruling that any and all claims remaining in the case are dismissed and all court costs will be paid by the plaintiff.
The case was filed against by Emilia Espinoza after her husband Jose Espinoza was shot by Levelland Police when they responded to a domestic disturbance call in January of 2015. Cases filed against some Levelland Police Officers had been previously dismissed by Judge Cummings.
It is noted that the plaintiff will have 30 days to appeal. The City of Levelland Attorney has not commented.
